Thaipanya Affiliate Terms
Effective 14 October 2026
These terms are an agreement between Thaipanya ("we") and the person or company joining the affiliate program ("you"). You accept them by clicking to accept when you sign up electronically, which has the same effect as a signature. They apply together with the Thaipanya Terms of Service and Privacy Policy; where they conflict on the affiliate program, these terms apply.
1. 1. Who can join
- Individuals aged 20 or over, or companies registered in Thailand.
- Each person or company may have one affiliate account.
- You take part as an independent contractor, not as our employee, agent or partner, and you may not make contracts, promises or collect money on our behalf.
- We may refuse or cancel a sign-up that contains untrue information or breaks these terms.
2. 2. Links, codes and counting
- You get your own referral link and referral code. You may choose your code within the system rules; we may refuse or change a code that is misleading, uses another person’s or organisation’s name, or is inappropriate.
- The referral code only identifies that a buyer came from you. The buyer’s discount is set by us in the system; you may not set, change or promise any other discount.
- We count only orders that carry your code when they are placed — either from clicking your link within 30 days before ordering, or because the buyer typed your code. If there are several codes, the latest one counts.
- A click counts when the buyer accepts referral cookies, or orders during that same visit.
- The buyer discount and your commission apply only to each buyer’s first purchase. We treat purchases as the same buyer when they use the same account, email or phone number. Once a buyer has received an affiliate discount — from anyone’s code — their later purchases are at the normal price and do not count for you, even with a referral code.
- These orders do not count: not actually paid, expired or cancelled · paid amount of 0 · placed by you, or with your account, email or phone number · test accounts · placed while your account is suspended · resulting from a breach of section 5.
- Counting follows our system records. You may dispute a period within 30 days of its cut-off date by emailing support@thaipanya.com with evidence; we will check the records and tell you the result.
3. 3. Commission
- Commission is a percentage of what the buyer actually paid after discount, at the rate shown on your affiliate page on the date the order’s payment came in.
- We may change the commission rate or the buyer discount with at least 15 days’ notice on your affiliate page or by email. Changes never apply to payments already received.
- If an order is cancelled or found to be fraudulent after it was counted, we remove the related commission; if already paid, we deduct it from your next period or ask for it back if there is nothing to deduct from.
4. 4. Payment and tax
- We close each period on day 25 of every month and transfer by day 5 of the following month, to a Thai bank account in your own name.
- A period balance below THB 500 is carried over to the next period.
- Before your first payment you must give true payee details — name, tax ID, address and bank account — and upload a copy of your ID and of your bank book for us to check. We transfer once these are verified.
- We withhold tax as required by law and issue a withholding tax certificate. You are responsible for filing your own income tax.
- If you do not complete or correct your payee details within 12 months of the first period that reached the minimum, we will email you at least twice before the deadline; after that, the unpaid commission lapses.
- If we reasonably suspect a breach of section 5, we may hold payment for up to 60 days while we check, and will tell you why.
- We pay domestic transfer fees. If a transfer fails because your bank details are wrong, the amount carries over to the next period after you fix them.
5. 5. Promotion you must not do
- Claim or imply that Thaipanya guarantees exam results, scores, admission chances or rankings, or can predict real exam results.
- Claim there are refunds, or offer discounts, gifts or other offers beyond what the system shows.
- Present yourself as us, our staff, or a representative of any school or exam, or imply that a school or authority endorses Thaipanya.
- Use the names or marks of the provider’s other brands, or of third parties, without permission.
- Send advertising without the recipient’s consent (spam), or contact children or minors directly to persuade them to buy.
- Bid on ads for the search terms "Thaipanya", "ไทยปัญญา" or similar, or use a website, account or domain name that could be confused with ours.
- Create fake clicks or orders, use bots, buy through your own code or accounts you control, or post your code on coupon or cashback sites without our written permission.
- Publish unlawful, defamatory or infringing content, or publish Thaipanya questions, answers or reports.
- Collect or ask for personal data of buyers or test takers on our behalf.
- Every post or clip with your link or code must tell viewers that you receive a referral fee, for example "#ad" or "#affiliate".
6. 6. Using the Thaipanya name and materials
- You may use the name, logo and materials we provide on your affiliate page only to promote under these terms, without altering them in a misleading way.
- What you say about the service must match the Thaipanya website at the time you post.
- This permission ends when these terms end, and we may ask you to remove non-compliant material.
7. 7. Personal data
- We collect and use your data to run your account, count referrals, pay you, withhold and remit tax, and prevent fraud, under this agreement and our legal duties. Details are in the Privacy Policy.
- Before uploading a copy of your ID card, cover the religion and blood type fields (if any) — we do not need them. We keep documents in access-restricted storage and only as long as tax law requires.
- You see only summary figures such as clicks, orders and commission, never buyers’ or test takers’ personal data.
8. 8. Suspension and ending
- You may leave the program at any time from your affiliate page; amounts earned before you leave that reach the threshold are paid in the normal cycle.
- We may end these terms with 15 days’ notice, or suspend and end them immediately if you breach section 5 or give false information. Amounts from the breach are not paid; other amounts that reach the threshold are paid in the normal cycle.
- We may close or change the whole program with 30 days’ notice; amounts earned before closing that reach the threshold are paid in the normal cycle.
9. 9. Liability
- You are responsible for your own content and promotion. If your breach of these terms leads to a claim or loss against us, you must compensate the actual damage.
- We do not guarantee any clicks, sales or income, and are not liable for indirect loss except where caused by our wilful act or gross negligence. Our total liability to you is limited to the commission due to you in the 12 months before the event.
- If a system failure prevents counting, we will try to recover from available records but are not liable for amounts with no record.
10. 10. Changes to these terms
- We may change these terms by issuing a new version with at least 15 days’ notice.
- You must accept the new version before your next payment; if you do not, you are treated as leaving the program under section 8.
11. 11. General
- These terms are governed by Thai law.
- We contact you by your registered email and your affiliate page. You can reach us at support@thaipanya.com.
- If any part cannot be enforced, the rest still applies.
This English version is provided for convenience. If it differs from the Thai version, the Thai version prevails.
